Order - Continuing Legal Education (CLE) – Reinstating the Live Credit Requirement Effective May 1, 2024 - Rescission of March 10, 2020 Order That Had Suspended the Requirement

The Court by Order dated March 10, 2020 having relaxed the twelve- credit live classroom instruction portion of the Continuing Legal Education compliance reporting requirement in response to the COVID-19 pandemic and the need to social distance; and

The public health emergency relating to COVID-19 having been concluded; and

The Court on October 17, 2023, having approved amendments to BCLE regulations that became effective as of January 1, 2024, including amendments to Reg. 103:1(n) that redefined “live instruction” to include courses in which the instructor is broadcasting live and attendees are attending live through an alternative verifiable learning format but not necessarily in the same physical location as the instructor and are able to interact with the instructor, as more particularly described in that regulation;

It is ORDERED that effective May 1, 2024, (a) the Court’s March 10, 2020 Order, relaxing the live requirement, is hereby rescinded effective immediately; (b) any credits obtained between March 10, 2020 and the effective date of this Order shall be considered live-credit hours; and (c) the live requirement is reinstated such that, going forward, courses must comply with the provisions of amended Reg. 103:1(n) to be considered "live" instruction.
