GENERAL EQUITY PART -- CHANCERY DIVISION

The General Equity Part of the Chancery Division is included in the Civil Division for case flow management purposes.  General equity cases are civil in nature, i.e., torts and contracts, but seek an equitable resolution of the conflict rather than a monetary judgment.  The General Equity caseload for the three counties of the vicinage are handled in Somerset County.

CONTESTED PROBATE

A civil judge also handles probate matters which include contested wills and adoptions, appointment of guardians and administrators, etc.  Probate matters are filed with the Surrogate, as Deputy Clerk of the Superior Court, who in turn refers contested matters to a Superior Court Judge assigned to handle contested probate matters.  A civil judge in each county of the vicinage handles the county's respective probate caseload.
