Appellate Division Decision in State of NJ in the Interest of A.K., a Juvenile

The Appellate Division of the Superior Court of New Jersey today released an unpublished opinion in the matter of State of NJ in the Interest of A.K., a Juvenile.

The consolidated opinion addresses the matter in which the Newark Morning Ledger Company, The Home News Tribune and The Record, joined by the New York Times Company, all publishers of widely circulated newspapers, sought leave to appeal from an April 25, 2003 order of the Family Part. The order in question was entered in connection with a pending juvenile court proceeding in which A.K., a ten-year-old boy, was arrested on March 26, 2003 for an alleged sexual assault and beating of a three-year-old boy, A.B., who died from his injuries on March 27, 2003.

The opinion also addresses a motion by The Newark Morning Ledger Company, to open A.K.'s juvenile court proceedings to the public and press. The Home News Tribune, The Record and The New York Times Company joined in the motion to open the proceedings.

The two-judge panel granted the motions for leave to appeal, consolidated the two matters and summarily reversed in part and affirmed in part.
