The Advisory Committee on Judicial Conduct (ACJC) has considered issues regarding the demeanor of Municipal Court Judge Daniel F. Murphy. After obtaining and reviewing the transcripts of proceedings before Judge Murphy and inviting him to comment on the propriety of certain remarks he made in court, the Committee has made the following determination.

Prior to the ACJC issuing a formal complaint, Judge Murphy contacted the Committee and expressed his wish to resign from the Peapack & Gladstone Municipal Court in lieu of undertaking any further defense or explanation of matters before the ACJC. He based that request on his age and the serious illness of his wife. Under the circumstances, the Committee concluded that Judge Murphy's resignation was the appropriate disposition and has closed its file in the matter without filing a formal complaint. The Supreme Court has concurred in the Committee's action.
