As set forth in the Notice to the Bar dated June 2, 2004 concerning an application pursuant to Rule 4:38A and the Mass Tort Guidelines to designate all pending and future silica litigation statewide as a mass tort, the Supreme Court has considered the application and the comments received in response to said notice and has determined not to designate the silica litigation as a mass tort at this time.
