On November 19, 1999, the Supreme Court adopted Rule 2:12A, Certification of Questions of Law by the Supreme Court, for a period of two years, effective January 3, 2000. The Rule creates a mechanism by which the United States Court of Appeals for the Third Circuit may petition the Court to certify a question of New Jersey state law. The Order of adoption further provided that the Court would evaluate its experience with the Rule in September 2001.
The Court has concluded that additional experience with the Rule will be necessary before a decision is made on whether the Rule should be retained permanently, in its present form or as modified. Accordingly, the Court has entered an Order, published herewith, extending Rule 2:12A for two additional years, through January 2, 2004, and until the further Order of the Court.
