Under civil best practices, Rule 4:24-1(c) permits parties, "by written and filed consent", to extend the track-based discovery period for an additional 60 days. In order to provide a standard procedure that will be followed uniformly in all counties, the Conference of Civil Presiding Judges has agreed that the phrase "by written and filed consent" shall require a consent order prepared by the parties and filed with the court. Such a consent order should ordinarily be filed only at the end of the discovery period, after the TIS reminder notice has been sent and all parties are in the case.
