The Supreme Court earlier appointed retired Appellate Division Judge Robert A. Fall as Special Master in In re Opinion 39 of the Committee on Attorney Advertising (E-18/19/20-06) to develop an evidentiary record to serve as the basis for the Court’s review of the determinations made by the Committee in the Opinion.
Petitioners had challenged the Committee’s conclusions regarding advertising that uses superlatives such as “super” and “best” and references in advertising to the attorney’s inclusion in lists that rate and rank lawyers.
The Special Master has filed his report, which has been forwarded to counsel in the case for supplemental briefing.
The Court also has authorized release of the report to the bar and the public on an informational basis only.
