Standards of Conduct for Mediators

The Supreme Court in January 2000 approved a set of Standards of Conduct for Mediators in Court-Connected Programs. The standards apply to all mediators, whether they are court staff, volunteers, or paid by the parties, when they are acting in state court-connected programs mediating matters in the Municipal Courts or in the Superior Court. The standards, which are intended to instill and promote public confidence in the mediation process and to be a guide to mediators in discharging their professional responsibilities, are being republished with this Notice.

The Advisory Committee on Mediator Standards was created to assist mediators seeking advice on interpretation of the standards and to monitor complaints about mediators received from attorneys or parties in mediation so as to provide data as to whether a more formal complaint process should be developed in the future. The membership of the Advisory Committee is drawn from the Supreme Court Committee on Complementary Dispute Resolution. Chief Justice Poritz recently reconstituted the Advisory Committee, which now consists of the following members: Superior Court Judge Stephan C. Hansbury (chair); Edward Dauber, Esq.; Professor Jonathan M. Hyman, Esq.; Suzanne M. McSorley, Esq.; and Richard H. Steen, Esq. Inquiries regarding the Standards and their application, including requests for clarification from the Advisory Committee, may be directed to:
