NOTICE TO THE BAR

RE: APPLICATION TO DESIGNATE BEXTRA AND CELEBREX LITIGATION AS A CONSOLIDATED MASS TORT

Pursuant to Rule 4:38A and the Mass Tort Guidelines (Directive #11-03), an application has been submitted to the Supreme Court to designate all litigation (pending and subsequently filed) alleging damage arising from the use of the drugs Bextra and Celebrex as a consolidated mass tort and to assign that litigation for centralized management to Atlantic County. Copies of the application can be obtained from the following:

Anyone wishing to comment on or object to this application should provide such comments or objections, with relevant supporting documentation, to me in writing at the following address by October 31, 2005:

It should be noted that an application was submitted previously to designate only the Bextra litigation as a mass tort. That still-pending application is being held in abeyance. Following the close of the comment period on the Bextra/Celebrex application, both applications and all comments submitted will be considered together by the Supreme Court.
