SUBJ: Special Civil Part Officers - Limited Liability Companies and Corporations

This Directive is being issued at the direction of the Judicial Council (from its April 21, 2005 meeting) to clarify that under existing directives Special Civil Part Officers may not organize themselves as limited liability companies or corporations.
Several provisions of Directives #4-01 (issued April 23, 2001) and #4-03 (issued July 3, 2003) governing the appointment of Special Civil Part Officers and their relationship with the Judiciary contemplate the appointment of a specific natural person possessing certain qualifications to perform non-delegable duties on behalf of the Special Civil Part. As such, limited liability companies and corporations may not be appointed as Special Civil Part Officers. Therefore, Special Civil Part Officers may not organize themselves as limited liability companies or corporations and, further, those few that are doing business as such must cease. Please ensure that copies of this directive are distributed to all Special Civil Part Officers in your respective vicinages.
