A notice was previously published advising of the application submitted by James J. McHugh, Jr., Esq. of the Beasley Firm , LLC to designate all Bextra litigation and Celebrex litigation as a consolidated mass tort and assign it for coordinated centralized management to the Atlantic Vicinage. That application was submitted pursuant to Rule 4:38A and the Mass Tort Guidelines as promulgated by Directive #11-03. This notice is to advise that the Supreme Court, after considering the application and the comments submitted in response to the notice, has designated the Bextra litigation and Celebrex litigation as a consolidated mass tort and assigned it to Superior Court Judge Carol Higbee in the Atlantic Vicinage for coordinated statewide management.
Published with this Notice are (1) the Supreme Court's December 6, 2005 order, and (2) Judge Higbee's December 21, 2005 case management order.
