The Bail/Intake Unit conducts bail investigations and indigence determinations for those defendants committed to the Hudson County Jail charged with indictable offenses. These defendants appear via video during which the court advises the inmate of the charges against him/her, the right to a public defender (if a defendant cannot afford to pay for an attorney), and the amount of bail set in the case. Once an initial bail amount is set, bail is reviewed by a superior court judge and/or at the request of the prosecutor or of the attorney of record. First appearances are conducted daily in Hudson's CJP Court (Central Judicial Processing) located at 595 Newark Ave., Rm. G5, Jersey City, NJ 07306.

A bail filing fee of $50.00 is required when bail is posted regardless of the type of bail required. Bail monies may be refunded by the Finance Division at the conclusion of the case provided all conditions have been met. Failure to appear for any scheduled court appearances may result in a bench warrant being issued for the defendant's arrest and the forfeiture of bail. Bail for all indictable cases and cases downgraded to the Municipal Court can be posted at the Hudson County Jail located in Kearny.

Presentence Investigation

A Presentence Investigation is required for all sentences in the Superior Court. The PSI is completed by probation officers assigned to the Criminal Division. This report supplies the sentencing judge with background information on the defendant and information about the crime the defendant pled guilty to or was found guilty of by a jury. The PSI is also used by Probation Supervision, Department of Corrections, and Parole if the defendant is sentenced to a State institution.

Pretrial Intervention

Pretrial Intervention is a diversionary program that is available to all persons that are charged with a criminal offense. Admission to the program may require defendant to enter a guilty plea for certain cases and may result in the dismissal of charges upon successful completion of this program. Even though this program is available to all defendants, there are certain limitations and therefore, you should consult with your attorney regarding eligibility requirements.

  • Applicants for PTI are required to pay a $75.00 application fee. This fee is waived only if you are indigent.
  • PTI applications should be made no later than twenty eight after indictment.
  • The enrollment period for PTI is from one to three years. It may include community service, restitution, drug and alcohol rehabilitation and payment of statutory fees.
  • Applications for PTI are accepted from Monday through Friday between the hours of 9:00 AM and 3:00 PM on a walk-in basis. You should bring with you all papers received from the court. The PTI offices are located at:

Mental Health

Through an agreement with the Jersey City Medical Center, Hudson Vicinage has a state certified mental health screener who screens defendants referred to her by the courts.

This unit provides the courts with mental health assessments on defendants suspected of suffering from mental illnesses. Assessments are also provided on certain defendants awaiting sentence or pending bail. If a defendant requires immediate hospitalization the screener can make that determination without delay.

Treatment Assessment Services for the Courts has been utilized by the Hudson Vicinage since its inception in 1978. This unit accepts referrals from the Criminal and Family Courts. Assessments are completed for Bail, PTI and PSI and Drug Court. The assessments include a substance abuse history, recommendation, and results of a drug screening. When appropriate this unit will arrange for treatment at a suitable treatment program. Drug Court

Drug Court is a highly specialized team process that functions within the existing Superior Court to address non-violent drug related cases. The objective focuses on treatment and recovery. This is a rigorous program requiring intense supervision, frequent court appearances, probation and treatment. Both treatment and recovery aspects are tightly structured and monitored

Criminal Customer Service:

This unit serves as the liaison to the public, attorneys and the Criminal Division. Some of its functions is the monitoring of eCourts, expungements and gun permits. In addition, it is responsible for the preparation of court files, the processing of records requests as well as managing these records.
