General Equity
The Honorable Hector R. Velazquez is the presiding judge of Hudson County’s Chancery Division-General Equity Part. The General Equity Part hears cases in which money is not the principle relief being sought. Instead of money, the plaintiff in a General Equity case may ask the court to order the defendant to do something or to enforce a right.
Cases commonly filed in the General Equity Part include, but are not limited to:
- Injunctions to compel a party to do something or cease doing something
- Property line disputes
- Partition of jointly owned properties
- Specific performance of contract
- Cancellation or reformation of mortgages
- Appointment of special medical guardians
- Termination or continuation of life support
- Quiet title

Filing fees may be paid by cash, money order or check. Money orders and checks should be made payable to “Treasurer, State of NJ”. Attorneys using a collateral account can file directly with the Chancery Clerk.

Probate
The Honorable Hector R. Velazquez is the presiding judge of Hudson County’s Chancery Division-Probate Part.
Examples of Probate Part cases include, but are not limited to:
- Litigation over contested wills
- Appointment of guardians for children and mentally incapacitated persons
- Distribution of estates
All Probate Part pleadings should be submitted to the Surrogate in the Probate Part office. Filing fees may be paid by cash, money order or check. Money orders and checks should be made payable to “Hudson County Surrogate”.

Foreclosure
Only emergent motions to stay sheriff sale, stay eviction and extend redemption period should be filed directly with the Hudson County Chancery Division. For more information, you may call the Chancery Clerk at (201) 795-6638.
The Office of Foreclosure in Trenton, NJ has jurisdiction over all uncontested Foreclosure matters. Contested answers and some motions that are filed in the Office of Foreclosure are forwarded to Hudson County’s Chancery Division to be heard by the Honorable Hector R. Velazquez.
Other than the emergent motions listed above, all pleadings (such as answers, non-emergent motions, and mediation requests) should be submitted to Foreclosure Processing Services.
