Court Rule 3:6-6(b) governing grand jury proceedings permit the defendant or the prosecutor to request a transcript at any time after an indictment has been returned.
Atlantic/Cape May Counties Grand Jury recently converted to a digital sound recording application (Courtsmart) that features the ability to burn an audio CD of the Grand Jury proceeding. Attorneys of record can complete transcript requests forms in the courtroom or access them here. For transcript request instructions, please see below.
PROCEDURE
In Atlantic County:
The Attorney of Record should complete the audio tape request form. The completed form can be emailed to Maria.Waldman@judiciary.state.nj.us or taken directly to the Finance Division window located on the first floor of the Mays Landing Criminal Courts Complex. A $10.00 dollar payment is required and payment should be made out to the State of New Jersey.
On the day of payment the audio grand jury CD will be burned. The CD will be ready for pick up within an hour.
In Cape May County:
The Attorney of Record should complete the audio tape request form. The completed form can be dropped off to the Jury Management office. A $10.00 dollar payment is required and payment should be made out to the State of New Jersey. The CD will be ready for pick-up in one or two days following the initial request.
SAMPLE FORM:
Please have the following information available to complete the form request: ordering party, attorney's telephone number, indictment number, exact date of court proceeding, and name of defendant. All boxes on the form must be completed.
