GUN PERMITS
The Assignment Judge appoints a judge to handle matters related to gun permits, such as Applications for Permits to Carry Handguns, License to Retail Firearms, and appeals from denials of Firearms Identification Cards and Permits to Purchase Handguns. Currently, a criminal division judge has been appointed to handle these matters in Atlantic and Cape May Counties.
Applications by civilians for permits to carry handguns are initially filed with the New Jersey State Police or their local police department (depending on the nature of the need to carry). After a background investigation by the law enforcement agency, the application is forwarded to the Superior Court for judicial review. The Prosecutor’s Office is also asked to perform a subsequent background check on the applicant. If the application is granted by the judge, a permit to carry is prepared and the applicant is notified pick up their permit. If denied, the applicant has the right to appeal the denial to the Appellate Division.
License to Retail Firearms applications, which initially come through the New Jersey State Police, are also forwarded to the Superior Court for review and approval or denial, then returned to the State Police for recording and distribution.
Appeals of denials of applications for Firearms ID Cards and Permits to Purchase Handguns made by the local municipal police chiefs are also heard by the judge assigned to hear gun permit matters.
